Terms of service
Last updated 27 October 2026
These terms cover your use of As It Happened, a service that hosts a private photo-sharing website for your event, such as a wedding, birthday or party. As It Happened is run by Jack Lowes, a sole trader in Australia (ABN to be added). In these terms "we" and "us" means Jack Lowes trading as As It Happened, and "you" means the person who creates an account.
By creating an account or paying, you agree to these terms, our privacy policy and our refund policy.
What you get
- A guest website at a free address (for example yournames.asithappened.app), protected by a guest password you choose.
- Guest uploads of photos and videos in full quality, a slideshow, and stickers you create.
- If you choose one and it's available under our price limit, a .party domain registered for one year. We register it on your behalf and remain the registrant. It isn't renewed automatically. When it lapses, your free address keeps working.
- The ability to download your photos and videos at any time.
It's a one-off payment with no subscription. Prices are in Australian dollars and include any GST that applies.
How long your site stays up
Your site and its photos stay online for at least two years after your event date, and after that for as long as we run the service. If we ever need to close the service or remove older sites, we'll email you at least 90 days before so you can download everything. Please keep your own copy of anything that matters to you. We don't promise that the service will never lose data.
Your account
- You must be 18 or older and give a real email address.
- Keep your password private. You're responsible for what happens under your account.
- You choose who gets your guest password. Anyone who has it can view and upload to your site.
Your content
You and your guests keep ownership of the photos, videos and stickers uploaded to your site. You give us permission to store, process, resize and display them only so we can run your site. We don't use them for advertising, and we don't sell them.
You're responsible for the content on your site and for having the right to upload it, including photos of other people used in stickers. You must not use the service for anything unlawful, for content that sexualises minors, harasses or threatens people, infringes someone else's rights, or contains malware. We may remove content or suspend a site that breaks these rules, and we'll tell you why unless the law prevents us.
Domain names
You can't choose a domain that infringes a trademark or someone else's name. Domain purchases are final with the registrar. If a domain can't be registered, your free address keeps working and we'll let you try another name.
Payments
Payments are processed by Stripe. We never see or store your full card details. If a payment is reversed or disputed, the site it paid for may be taken offline until it's resolved. See the refund policy for refunds.
Our responsibility
Nothing in these terms excludes, restricts or changes your rights under the Australian Consumer Law, including the consumer guarantees that services will be provided with due care and skill. Apart from those rights, the service is provided as is, and we're not liable for indirect or consequential loss. Where the law lets us limit our liability, it's limited to supplying the service again or refunding what you paid.
We work hard to keep the service running, but it relies on third parties such as Cloudflare and Stripe, and we can't promise it will never be interrupted.
Ending your account
You can ask us to delete your account and site at any time by emailing us. We may close an account that seriously or repeatedly breaks these terms.
Changes
We may update these terms. If a change matters to you, we'll email you before it takes effect. The terms that applied when you paid continue to apply to that purchase.
Law
These terms are governed by the laws of Australia and the state in which we operate.
